WORKERS' COMPENSATION
What to do after an injury at work:
Tell your employer immediately. Although you have up to 30 days to notify your employer of your work related injury or illness, it is very important to notify your employer and seek medical care as soon as possible. It is best to notify your employer in writing, and keep a copy of your report to your employer. Remember who you told and what you told them. Be sure to explain specifically that the injury occurred while working or was work-related.
Call your attorney Although New York’s Workers’ Compensation Law allows you up to two years to file your claim, it is important to file your claim as soon as possible after the incident. Mr. Bopp wants to help a disabled employee overcome the potential loss of income and to protect all of your rights under the workers’ compensation law.
Important. Please remember Workers’ Compensation is insurance. It is paid for you by your employer so you can receive monetary benefits and medical care if you are injured, disabled, become sick or develop an occupational illness at your job. Think of it as an insurance claim to which are entitled. You are not "suing" your employer. In fact, you cannot sue your employer directly or not to the job injury.

SOCIAL SECURITY DISABILITY
if you are disabled and unable to work due to an illness, injury, psychological condition or a combination of problems, and the condition has lasted or is expected to last a year or longer or result in death, you maybe elegible for Social Security disability benefits from the federal government. SSD benefits are benefits you have paid for through your Social Security taxes, but there are eligibility requirements to have not been working or have not worked long enough.
The Social Security Administration determines if you're unable to work and if you are able to find some other substantial gainful employment, based on your age, education and work experience. Information about the process can be found at www.SSA.gov. If you have returned to work, but were disabled from working for a year or longer, you may still be able to collect benefits for the time you were disabled and unable to work.
The application process for Social Security disability benefits can be very lengthy, and for some people can last year or longer. If you are unable to work due to a physical or mental disability, call for a free consultation to discuss your situation. You should also be sure that if you are unable to work because of a medical condition, that you go to the doctor regularly and have your condition documented, since the Social Security Administration must rely on sufficient and ongoing medical reports backed by appropriate medical tests, such as MRIs, EMGs, x-rays, psychiatrists' evaluations, etc.
